Subject: 9548/Choo Choo Aniversary Special Date: Fri, 18 Aug 1989 14:54:00 -0500 ORDINANCE NO. 9548 AN ORDINANCE AUTHORIZING THE APPROPRIATION OF SUM OF THIRTY-FIVE THOUSAND ($35,000) DOLLARS TO THE CHATTANOOGA CONVENTION AND VISITORS BUREAU FOUNDATION, A 501(C)(4) ORGANIZATION FOR FUNDING THE "CHOO CHOO ANIVERSARY SPECIAL" TRAIN FROM NEW YORK TO WASHINGTON, D.C TO ATLANTA, GEORGIA TO CHATTANOOGA IN ORDER TO PROMOTE CHATTANOOGA AS A POTENTIAL SITE TO LOCATE BUSINESSES AND TO PROMOTE THE LOCAL TOURIST INDUSTRY. _________________________ WHEREAS, The Chattanooga Convention and Visitors Bureau Foundation is a non-profit civic organization organized for the purpose of promoting the City of Chattanooga as a potential site to locate businesses and to promote the City of Chattanooga as a local tourist attraction; and WHEREAS, the Chattanooga Convention and Visitors Bureau Foundation is a non-profit civic organization qualified under Section 501(c)(4) of the Internal Revenue Code of 1954, as amended; and WHEREAS, it is in the interest of the common good and general welfare of the citizens of the City of Chattanooga that funds be made available to allow the Chattanooga Convention and Visitors Bureau Foundation to carry out the purposes for which it was organized and to bring about civic betterments and social improvements; and WHEREAS, it is advisable that those persons or entities who wish to make grants or contributions to or for the benefit of the City of Chattanooga, have a mechanism under which such gifts can be made of carrying out the purposes for which Chattanooga Convention and Visitors Bureau Foundation was organized. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, that: SECTION 1. The sum of $35,000 be appropriated to the Chattanooga Convention and Visitors Bureau Foundation for the funding of the "Choo Choo Aniversary Special" train trip beginning in New York, New York, to Washington, D.C. to Atlanta, Georgia and then to Chattanooga, Tennessee for the purpose of locating officials from companies who wish to locate businesses within Chattanooga, Tennessee and to promote the local tourist industry in this area. Such sums shall be payable from the contingency fund of the City of Chattanooga. SECTION 2. BE IT FURTHER ORDAINED that the Budget Ordinance of the City of Chattanooga for the fiscal year 1990-1991, Ordinance No. 9423 shall also be amended to include the sum of $35,000 which shall be payable from the contingency fund as an expenditure to the Chattanooga Convention and Visitors Bureau Foundation for funding of the "Choo Choo Aniversary Special" train trip. SECTION 3. BE IT FURTHER ORDAINED that this Ordinance shall restrict any appropriation of funds to be used for the purpose of maintaining and increasing employment opportunities in the City of Chattanooga by promoting industry, trade, commerce, tourism and recreation and by inducing manufacturing, industrial, governmental, educational, financial, service, commercial, recreational and agricultural enterprises to locate in or remain in the City of Chattanooga or to locate nearby in order to provide jobs for residents of the City in accordance with the guidelines set forth within Chattanooga City Code, Section 2-326. SECTION 4. BE IT FURTHER ORDAINED that as a prerequisite of obtaining any funds from the City of Chattanooga, the Chattanooga Convention and Visitors Bureau Foundation shall file with the Mayor and City Clerk a copy of its annual report of its business affairs and transactions including its annual audit, its program of benefit to the residents of the City of Chattanooga and its proposed use of municipal assistance which can be reviewed by the public prior to the expenditure of any funds. SECTION 5. BE IT FURTHER ORDAINED that prior to making this appropriation to the Chattanooga Convention and Visitors Bureau Foundation notices were published in a newspaper of general circulation in the municipality of the intent to make this appropriation to a non-profit charitable organization specifying the amount of the appropriation the purposes, for which the appropriation was to be spent and the City Council has approved the appropriation at two (2) regularly scheduled meetings in accordance with Chattanooga City Code Section 2-326. SECTION 6. BE IT FURTHER ORDAINED that this Ordinance shall take effect two (2) weeks from and after its passage as required by law.
